GENERAL CONDITIONS FOR THE PURCHASE OF TICKETS

The user of Artsupp's services (hereinafter "User") is required to consult these general conditions for the purchase of tickets (hereinafter "Purchase Conditions") through the website www.artsupp.com (hereinafter "Site") or through the services, features, content, applications, websites, or widgets connected to Artsupp (hereinafter the "Services").
These Purchase Conditions may be subject to changes. Therefore, it is the User's responsibility to check the current version on the website https://artsupp.com/en/terms-and-conditions at the time of use. The use of the Services or the Site constitutes acceptance of the Terms of Use. All services of Artsupp, including the sale of tickets and other goods and services, are subject to these Purchase Conditions. WHO WE ARE
The Site is a platform dedicated to the promotion of art, artists, and artistic and cultural institutions. The contents of the Site and the rights related to them are reserved and can only be consulted for personal information purposes; any other use is expressly prohibited without prior written consent from Artsupp.
The Artsupp brand and platform are owned by the company Restart S.r.l., based in Rome at Viale Angelico no. 101, registered in the Business Register under no. RM - 1450606, tax code and VAT number 13481941006, hereinafter referred to as "Artsupp".
Artsupp acts as a ticketing intermediary, selling tickets through the Site and the Services on behalf of the Partners, and therefore has no control over the availability of tickets which depends solely on the Partner, nor does it have any role in setting prices or in organizing and managing the activities following the purchase of tickets.
1. DESCRIPTION OF THE SERVICE
All tickets purchased through our Services are subject to:
- these Purchase Conditions;
- our Terms of Use;
- our Privacy Policy;
- the terms and conditions of the Event, if specified;
- any additional terms and conditions of the Partners listed on their respective websites or at the venue itself or disclosed during the ticket purchase process.
These Purchase Conditions govern the provision and use of Artsupp's Services and consequently, the provision to users of booking and pre-sale services for events organized and managed by the Partner.
Under the Purchase Contract, Artsupp acts in the name and on behalf of the Partner, providing exclusively its own Services for this purpose. Specifically, the Services provided by Artsupp consist solely of the booking and pre-sale of tickets for the Partner's events (hereinafter "Events").
When purchasing tickets from Artsupp, the User is required to comply with the current regulations and the purchase conditions of the individual Partners, including any age limits for attending the Events.
Artsupp reserves the right to withdraw, modify, suspend, or discontinue any function or service for technical and/or organizational reasons, or at the request of the Partner or the authorities responsible for protecting public order and safety. In such a case, the User may request a replacement or refund of the paid ticket from Artsupp, waiving any further claims for damages, both material and immaterial.
In any case, Artsupp assumes no responsibility for any direct or indirect damages of any kind suffered by the user/visitor in relation to the sale of tickets and related services. Artsupp reserves the right to apply, for technical or security reasons, limitations and exclusions on the payment methods that the User can use for the purchase of tickets and related services.
The number of tickets that can be purchased through the Site or the Services may be limited (as specified on the order page of the Site or the Services). Artsupp's services end with the issuance of the pre-sale ticket. Therefore, any occurrence that occurs afterward (including but not limited to: change of date/time, location, program, artist, or cancellation of an event) will be the sole responsibility of the Partner.
2. PAYMENT METHODS - CONTRACT CONCLUSION - INVOICING
The price of the tickets or items listed on the Site or the Services includes VAT, including any pre-sale fees applied by Artsupp, and corresponds to the price indicated on the order page of the Site at the time the order is concluded. Artsupp has the right to apply, on each sales transaction and in addition to the pre-sale fees, service fees based on agreements with the Partners.
The payment methods for Tickets are indicated on the Artsupp sales page and immediately before payment. Artsupp reserves the right to vary and apply limitations and exclusions to the payment methods that the User can use for payment. By pressing the "Buy Tickets" button on the Site or the Services, the User makes an offer to Artsupp to purchase the tickets.
The offer is considered accepted by Artsupp in the name and on behalf of the Partner only if the payment has been successful. Immediately after the transaction is completed, the User will receive a confirmation email of the purchase made, specifying the purchase details (it is therefore important to provide Artsupp with a correct address). If an invoice for VAT purposes is needed for a ticket (or tickets), please contact the respective Partner.
The Artsupp Service provides a limited period of time for the payment of the Tickets placed in the shopping cart (hereinafter the "Booking Time"). The Booking Time is clearly indicated on the shopping cart summary page, marked by the icon indicating the exact term by which the payment of the Access Title must be made.
3. SECURITY
To ensure maximum security, online transactions of purchases with the Artsupp Service are carried out using the payment services offered and fully managed by STRIPE Inc. (or any other payment service provider discretionarily identified by Artsupp), through their platforms, which constitute market standards. The purchase process takes place through the SSL (Secure Socket Layer) protection system, whereby Artsupp never becomes aware of the codes used by the User to activate their card but only receives a confirmation code of the successful transaction from the third-party electronic payment platform manager at the conclusion of the transaction.
4. METHODS OF COLLECTION AND DELIVERY
For online purchases, the User has the option to choose between the following ticket collection methods:
Print at home or paperless access: The user can print the tickets at home or present the paperless ticket directly on their smartphone. It is mandatory to show the booking confirmation and the purchase made in one of the two methods at the ticket office.
5. RESELLING OF TICKETS
No ticket purchased in advance may be transferred for a fee nor may it be subject to brokerage.
It is also not possible to duplicate a ticket, for instance, by taking a screenshot of the ticket on your device, or in the case of streaming events, sharing your access credentials with third parties.
Any resale or transfer (or attempt to resell or transfer) of a ticket in violation of the above provisions will result in the immediate invalidation or cancellation of the ticket without refund or other compensation and may result in the total suspension of the use of the Site and the Services by the original ticket holder at the sole discretion of Artsupp.
6. RIGHT OF WITHDRAWAL
Upon the successful completion of the purchase process, the User expressly acknowledges and agrees that Artsupp, acting on behalf of the Partner, is not authorized to refund or replace purchased tickets. In case of a canceled or postponed event, the User must contact the Partner exclusively to request a refund of the price of the tickets purchased through the Site or the Services.
7. ACCESS TO ARTSUPP SERVICES
The user may use the Artsupp Services for personal use and agrees not to use them for any purpose prohibited by these Terms of Use. To purchase a ticket or access certain features, the user will need to register an account. At the time of registration, you will be required to provide your name and email address. The user agrees to provide accurate and up-to-date information as required at the time of account registration and agrees to promptly update their data in case of changes.
8. LANGUAGES
These terms, as well as all information regarding monumental sites, museums, exhibitions, and events, are available in both Italian and English.
9. COMPLAINTS
For any comments or complaints regarding the Artsupp Service, please use the Help and Support form available on the site. All requests will receive a response. User comments are very valuable and help to constantly improve the service to better meet the needs of Users.
10. LIMITATION OF ARTSUPP'S LIABILITY
Except in cases of willful misconduct or gross negligence, Artsupp shall not be held liable for any direct or indirect damages of any kind suffered by the Customer in relation to the sale of tickets. Artsupp disclaims any responsibility in case of unavailability of the online sales portal due to force majeure, such as anomalies in the User's computer equipment, third-party events, cyber-attacks, or internet network unavailability. Artsupp will not be responsible in case of loss, theft, or unlawful use of tickets, nor will it be required to respond to duplicate ticket requests in case of loss or theft.
11. INTELLECTUAL PROPERTY
All copyrights, trademarks, and any intellectual property rights in the materials or content presented as an integral part of the artsupp.com website are owned by Artsupp and those who have licensed their use. Unless otherwise explicitly stated in these conditions, Artsupp does not grant any right to use such material. This does not prevent the use of this website to the extent necessary to complete the purchase of tickets.
12. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed exclusively by Italian law. For any disputes concerning online purchases made by a user as a consumer using the Artsupp service, the court of the consumer's place of residence or elective domicile shall have jurisdiction. In all other cases, any disputes regarding the validity, interpretation, performance, and/or termination of legally relevant acts related to the Artsupp service contract shall be subject to the exclusive jurisdiction of the Rome Court.
Pursuant to and for the purposes of Articles 1341 of the Civil Code and Article 33 of Legislative Decree no. 206 of September 6, 2005 (Consumer Code), the user expressly approves the following articles of the Contract:
